Coach has filed to dismiss its lawsuit against Gap Inc., according to a Tuesday court filing. The case was a trademark infringement complaint over the use of the word “coach” on Old Navy products.
The lawsuit, filed on April 3 in the U.S. District Court for the Central District of California, was dismissed in its entirety without prejudice by Coach parent company Tapestry.
Tapestry previously claimed Coach had “suffered substantial damages” as a result of the Old Navy products, and said the products were “likely to create a false impression and deceive consumers, the public, and the trade into believing that there is a connection or association between” the brands.
Gap never filed an official response to the claim in court because its response wasn’t due until May 29. A Gap spokesperson didn’t immediately respond to Fashion Dive’s request for comment.
In the weeks following Tapestry’s complaint against Gap, the company was sued by the Federal Trade Commission to block a pending deal to acquire Capri Holdings. That merger, if successful, would combine Tapestry’s Coach, Kate Spade and Stuart Weitzman brands with Capri’s Michael Kors, Jimmy Choo and Versace brands. That case is ongoing.
Earlier this month, Tapestry reported net sales of $1.48 billion, a 2% year-over-year decrease. Each of its brands experienced a decrease, except Coach, which saw flat sales.
